Terms of Service

Effective April 19, 2026

These Terms of Service ("Terms") govern your access to and use of the AI Image Lab website, applications, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who we are

"AI Image Lab" ("AI Image Lab", "we", "us", "our") operates the Service. We may provide the Service in a testing, preview, or production state. Features may change over time.

2. Eligibility

You must be legally able to form a binding contract to use the Service. You are responsible for ensuring your use of the Service complies with all applicable laws, regulations, and rules.

3. Accounts and security

If accounts are enabled, you are responsible for maintaining the confidentiality of your login credentials and any API keys issued to you. You agree to notify us promptly of any unauthorized use or security breach.

4. The Service

The Service enables users to submit prompts and parameters (and, when available, uploads) to generate images. Generated outputs may be stored and made available for download.

5. Acceptable use (strict) — zero tolerance for illegal activity

You may not use the Service for any unlawful, harmful, fraudulent, abusive, or otherwise objectionable activity. We enforce a strict acceptable use policy. Violations may result in immediate suspension or termination.

5.1 Prohibited content and conduct

  • Child sexual abuse material (CSAM). You must not create, request, upload, store, distribute, or attempt to generate any CSAM or sexual content involving minors. Zero tolerance.
  • Sexual content involving minors. Any depiction of minors in a sexual context is prohibited, including "youthful" or ambiguous depictions intended to sexualize minors.
  • Illegal pornography and exploitation. Non-consensual sexual content, coercion, exploitation, trafficking-related content, or any sexual violence is prohibited.
  • Violence and threats. Content that promotes or incites violence, terrorism, or credible threats of harm is prohibited.
  • Hate and harassment. Content that targets individuals or protected classes with harassment, hate, or dehumanization is prohibited.
  • Illicit activities. Instructions for wrongdoing, facilitation of criminal activity, or content intended to aid unlawful acts is prohibited.
  • Invasion of privacy. Doxxing, generating or sharing personal data, or attempting to identify private individuals is prohibited.
  • Fraud and impersonation. Misleading impersonation, scams, and deceptive conduct is prohibited.

5.2 Copyright and intellectual property

You may not use the Service to infringe intellectual property rights. This includes uploading or generating content that violates copyright, trademark, right of publicity, or other rights. You represent and warrant that you have all necessary rights, licenses, permissions, and consents to submit any inputs (including uploaded images) and to use any outputs for your intended purpose.

5.3 Enforcement and cooperation with law enforcement

We reserve the right (but do not assume the obligation) to monitor, review, remove, or restrict access to any content or activity in connection with the Service. If we suspect illegal activity or prohibited content (including CSAM), we may:

  • Immediately suspend or terminate access to the Service.
  • Preserve relevant logs, prompts, uploads, outputs, and metadata as permitted or required by law.
  • Report suspected violations to appropriate authorities and cooperate with law enforcement, including responding to lawful requests.

6. Your content; outputs; ownership

As between you and AI Image Lab, you retain any rights you may have in your inputs. Subject to these Terms, you may use outputs generated through the Service. You are solely responsible for how you use inputs and outputs, including ensuring legality, compliance, and rights clearance.

7. No warranties; “as-is” service

THE SERVICE AND ALL OUTPUTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI IMAGE LAB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY OUTPUTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO USE THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless AI Image Lab and its operator(s) from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your inputs, outputs, or use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another party.

10. Suspension and termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms or pose risk to the Service, other users, or the public. Upon termination, your right to use the Service will cease.

11. API keys, rate limits, and usage

If we issue API keys, you must keep them confidential and use them only as authorized. We may implement rate limits, quotas, usage caps, or plan-based restrictions. Attempting to bypass controls or abuse the Service is prohibited.

12. Changes to the Service and Terms

We may modify or discontinue the Service (in whole or part) at any time. We may also update these Terms. We will post updated Terms on this page and update the effective date. Continued use of the Service after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by applicable law in the jurisdiction of the Service operator, without regard to conflict of law principles.
